Supreme Court sides with producer in case over sample in Flo Rida hit – NBC 5 Dallas-Fort Worth
SUMMARY: The Supreme Court ruled in favor of a music producer, Sherman Nealy, allowing him to seek damages going back over a decade for a sample used in the 2008 hit song “In the Ayer” by Flo Rida. Nealy sued after discovering his former collaborator allowed the sampling without his knowledge. The decision, supported by a 6-3 vote, clarified that copyright owners are entitled to damages for infringement regardless of when it occurred. The dissenting justices raised concerns about the validity of Nealy’s claim and whether older violations should be subject to legal action without evidence of fraud.
